These Terms of Service (“Terms”) govern your use of the website redflowertemple.com and any purchases made through it. Please read them carefully before placing an order or subscribing to any service.

By accessing the website or completing a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the website.


1. About us

Red Flower Temple is operated by Florencio Rojas. The store sells physical Japanese art supplies, art prints, and books, as well as digital subscription-based drawing courses.

We are a business selling to consumers (B2C). These Terms are written in accordance with EU consumer law and are intended to be clear and fair.

 

2. Acceptance of terms

By placing an order on this website, you confirm that:

  • You are at least 18 years of age, or have the consent of a parent or legal guardian
  • The information you provide during checkout is accurate and complete
  • You have read and understood these Terms


These Terms apply to all transactions conducted through redflowertemple.com, regardless of the device or platform used.

3. Products, pricing & availability

3.1 Physical products

We offer Japanese art supplies, books, art prints, and related materials. Product descriptions, images, and prices are provided in good faith and are as accurate as possible. We reserve the right to correct errors in pricing or descriptions at any time before your order is confirmed.

All prices are displayed in EUR and include applicable VAT unless stated otherwise. Shipping costs are calculated and displayed at checkout before you finalise your order.


3.2 Digital subscription — Mastering the Basics

The Mastering the Basics seminar is a subscription-based digital course providing ongoing access to video lessons, course materials, and a community platform. Subscriptions are available on a monthly or 6-month prepaid basis, as described at the point of purchase.


3.3 Availability

We reserve the right to limit quantities, discontinue products, or modify the content of the seminar at any time. In the event a product you have ordered becomes unavailable after payment, we will notify you and offer a full refund.

 

4. Orders and contract formation

Placing an order on our website constitutes an offer to purchase. A binding contract between you and Red Flower Temple is formed only when we send you an order confirmation by email. We reserve the right to decline or cancel any order, for example in cases of pricing errors, suspected fraud, or stock unavailability.

For digital subscriptions, the contract is formed upon completion of the checkout process and receipt of your confirmation email. Access to the course content is activated shortly thereafter.

5. Payment

We accept the following payment methods: Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, iDEAL, Bancontact, Maestro, Shop Pay, and UnionPay. Payment is processed securely via Shopify Payments or other authorised payment providers.

All transactions are processed in EUR. If your bank account is in a different currency, your bank may apply a conversion rate and/or fee — this is outside our control.

For subscription products, your payment method will be charged automatically at the start of each billing cycle. You can cancel your subscription at any time through your account to prevent future charges.

 

6. Delivery (physical products)

We ship worldwide. Estimated delivery times and shipping costs are displayed at checkout. Delivery times are indicative and may vary depending on your location, carrier performance, and customs clearance.

Risk of loss and title for physical goods passes to you upon delivery. If your order is lost or damaged in transit, please contact us promptly so we can assist.

For shipments outside the EU, customs duties and import taxes may apply. These are the responsibility of the buyer and are not included in our prices or shipping fees.

 

7. Digital service — access and account

Upon subscribing to Mastering the Basics, you will receive access to the course platform through your account at redflowertemple.com. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Your subscription is personal and non-transferable. Sharing account access with others is not permitted. We reserve the right to suspend or terminate access in the event of misuse or suspected account sharing.

We will make reasonable efforts to ensure the platform is available at all times, but we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.

 

8. Returns, cancellations & refunds

Our return and refund policy is set out separately in our Return & Cancellation Policy, which forms part of these Terms and is available at redflowertemple.com/pages/returns. Key points:

  • EU consumers have a 14-day right of withdrawal for physical goods, starting from the date of delivery
  • The right of withdrawal for digital content is waived once you activate access to the course, provided you have given your express consent at checkout
  • Defective or incorrect physical products are covered under the EU two-year legal guarantee
  • Subscription cancellations take effect at the end of the current billing period

 

9. Intellectual property

All content on redflowertemple.com — including course videos, written materials, illustrations, artwork, photographs, and the Mastering the Basics curriculum — is the intellectual property of Florencio Rojas or licensed to Red Flower Temple. All rights reserved.

You are granted a limited, personal, non-exclusive, non-transferable licence to access and use course content for your own personal learning. You may not:

  • Reproduce, distribute, or publicly share course content in any form
  • Upload, stream, or repost course videos on any platform
  • Use course materials for commercial purposes or teach from them without written permission
  • Remove or alter any copyright or attribution notices

Unauthorised use of our intellectual property may result in immediate termination of your access and legal action.

10. Acceptable use

When using our website, community platform, or course content, you agree not to:

  • Post or share content that is offensive, defamatory, discriminatory, or unlawful
  • Harass, intimidate, or harm other community members
  • Attempt to gain unauthorised access to our systems or another user’s account
  • Use automated tools to scrape, copy, or index our website content
  • Impersonate Red Flower Temple, Florencio Rojas, or any other person

We reserve the right to remove content and suspend or terminate accounts that violate these standards, without prior notice.

 

11. Limitation of liability

To the fullest extent permitted by applicable law, Red Flower Temple shall not be liable for any indirect, incidental, or consequential damages arising from your use of the website, course content, or physical products, including but not limited to loss of data, loss of profits, or personal injury caused by misuse of art materials.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under EU consumer law.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the product or service giving rise to the claim.

 

12. Privacy and data

We collect and process personal data in accordance with our Privacy Policy, available at redflowertemple.com/policies/privacy-policy. By using our website and services, you consent to such processing.

We use your data to process orders, manage your subscription, communicate with you about your account, and improve our services. We do not sell your personal data to third parties.

13. Changes to these terms

We may update these Terms from time to time. The current version is always available on our website. For material changes, we will notify existing subscribers by email at least 30 days before the changes take effect. Your continued use of the website or subscription after that date constitutes acceptance of the updated Terms.

If you do not accept the updated Terms, you may cancel your subscription before the changes take effect and receive a prorated refund for any unused prepaid period.

 

14. Governing law and disputes

These Terms are governed by the laws of the Netherlands. If you are a consumer in the EU, you also benefit from any mandatory consumer protection provisions of the law of your country of residence, which cannot be excluded by contract.


If a dispute arises between you and Red Flower Temple that we cannot resolve amicably, you have the right to:

  • Submit a complaint to the Dutch Authority for Consumers and Markets (ACM) at acm.nl
  • Use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr
  • Pursue your rights through the courts of your country of residence (for EU consumers)


We are not obligated to participate in alternative dispute resolution procedures, but we commit to responding to all complaints in good faith within 14 business days.


15. General provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right.


These Terms, together with the Return & Cancellation Policy and Privacy Policy, constitute the entire agreement between you and Red Flower Temple regarding your use of our website and services.
